Cattaraugus County District Attorney Report - February 1, 2016

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, February 1, 2016:
Arraignments:
JESSE C. BARTLETT, JR., 25, of  Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Rape in the Third Degree, a class E felony.  The crime occurred in March 2015, in the City of Salamanca, when Bartlett being twenty-one years old or more, allegedly engaged in sexual intercourse with another person less than seventeen years old.  The matter has been adjourned for motions.

CHARLES P. REDEYE., 54, of  Salamanca, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with two counts of Robbery in the Second Degree, class C felonies; Grand Larceny in the Third Degree, class D felony; Grand Larceny in the Fourth Degree, class E felony; Assault in the Second Degree, class D felony and Criminal Possession of Stolen Property in the Third Degree, class E felony.  The incident occurred on May 4, 2015, in the Town of Salamanca, when Redeye allegedly forcibly stole property and caused physical injury to another person and the value of the property exceeded $3,000.00.  The matter has been adjourned for motions.
Guilty Pleas:
TABATHA JOHNS, 24, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Burglary in the Third Degree, class E felony.  The incident occurred on November 28, 2015, in the City of Olean, when Johns knowingly attempted to enter or remain unlawfully in a building with the intent to commit a crime therein.  Sentencing is scheduled for April 4, 2016.

DALE H. LAFFERTY, 51, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, class E felony; Aggravated Unlicensed Operation in the Second Degree, a misdemeanor. The incident occurred on September 17, 2016, in the City of Olean, when Lafferty operated a motor vehicle on a public highway with a BAC .14%. Sentencing is scheduled for April 4, 2016.

JARRED W. MURPHY, 26, of Salamanca, New York but presently incarcerated in the Cattaraugus County Jail, entered a plea guilty to Assault in the Second Degree, class D felony to satisfy a indictment. The crime occurred on March 26, 2015, in the City of Salamanca, when the defendant, having a depraved indifference to human life, recklessly caused serious physical injury to the brain of a child less than five years old by shaking or slamming or throwing the child so as to impact the child’s head on a hard surface or object.  Sentencing is scheduled for April 4, 2016.
Sentences:
THOMAS C. HALL a/k/a “Turtle”, 54, of Olean, New York, was sentenced as a PREDICATE FELONY OFFENDER to an indeterminate term of 7 ½ years -15 years with the New York State Department of Corrections for his conviction to Criminal Facilitation in the Second Degree, class C felony.  The incident occurred between August 7, 2014 and August 8, 2014 in the town of Allegany, when the defendant believing it probable that he was rendering aid to a person who intended to commit a class A felony, engaged in conduct which provided such person with means or opportunity for the commission thereof and which in fact aids such person to commit such class A felony.

JOHN M. HALUSKA, 65, of Frewsburg, New York, was sentenced to 5 years probation for his conviction to Criminal Possession of a Weapon in the Third Degree, a class E felony.  The incident occurred on November 11, 2014, in the Town of South Valley, when the defendant possessed an explosive or incendiary bomb.
