Cattaraugus County District Attorney Report - Feb. 22, 2016

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, February 22, 2016:

Arraignments

AMANDA L. BORNER., 21, of Perrysburg, New York, was arraigned and entered a plea of not guilty to an indictment that charges her with Criminal Possession of a Controlled Substance in the Fifth Degree, class D felony; Criminal Using Drug Paraphernalia in the Second Degree, class A misdemeanor; Criminal Possession of a Controlled Substance in the Third Degree, a class B felony; Criminal sale of a Controlled Substance in the Third Degree, class B felony.  The incident occurred on September 25, 2015, in the City of Gowanda, when she allegedly possessed and sold a narcotic drug and possessed material suitable for packaging individual quantities, packaging or dispensing of narcotic drugs or stimulants.  The matter has been adjourned for motions.

GUNNAR DOLE, 24, of Gowanda, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Third Degree, a class B felony; Criminal sale of a Controlled Substance in the Third Degree, class B felony.  The crime occurred on September 25, 2015, in the City of Gowanda, when Dole allegedly possessed and sold a narcotic drug.  The matter has been adjourned for motions.

ANDREW ESTRADA, 20, of Gowanda, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Fifth Degree, class D felony; Criminal Using Drug Paraphernalia in the Second Degree, class A misdemeanor; Criminal Possession of a Controlled Substance in the Third Degree, a class B felony; Criminal sale of a Controlled Substance in the Third Degree, class B felony.  The incident occurred on September 25, 2015, in the City of Gowanda, when the allegedly possessed and sold a narcotic drug and possessed material suitable for packaging individual quantities, packaging or dispensing of narcotic drugs or stimulants.  The matter has been adjourned for motions.

INDIGO VANTINO, 21, of Gowanda, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Fifth Degree, class D felony; Criminal Using Drug Paraphernalia in the Second Degree, class A misdemeanor; Criminal Possession of a Controlled Substance in the Third Degree, a class B felony; Criminal sale of a Controlled Substance in the Third Degree, class B felony.  The incident occurred on September 25, 2015, in the City of Gowanda, when Vantino allegedly possessed and sold a narcotic drug and possessed material suitable for packaging individual quantities, packaging or dispensing of narcotic drugs or stimulants.  The matter has been adjourned for motions.

Guilty Pleas

TRAVEN HOLMES, 28, of Delevan, New York, entered a plea of guilty to Course of Sexual Conduct Against a Child in the First Degree, a class B felony and Forcible Touching, a class A misdemeanor to satisfy a pending indictment.  The incidents occurred between 2006 and 2014, in the Town of Machias when Holmes engaged in criminal sex act with a victim between 8 and 9 years old.  Sentencing is scheduled for April 25, 2016.

TERRY DECHOW, 49, of Randolph, New York, entered a plea of guilty to Driving While Intoxicated, a class E felony and Refusal of Breath Screen, a violation to satisfy a pending indictment.  The incident occurred on September 9, 2015 in the Town of Napoli when the defendant operated a motor vehicle on a public highway in an intoxicated condition and refused to submit a breath test to be administered.  Sentencing is scheduled for April 25, 2016.

TRAVIS M. GILBERT, 27, of Salamanca, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Burglary in the Third Degree, a class D felony.  The crime occurred on December 8, 2015, in the City of Salamanca, when Gilbert knowingly entered or remained unlawfully in a building with intent to commit a crime therein.  Sentencing is scheduled for April 25, 2016.

ADAM K. GERLAND, 25 of Cuba, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Criminal Possession of a Controlled Substance in the Third Degree, class B felony.  The crime occurred on December 25, 2015 in the City of Olean, when Gerland knowingly and unlawfully possessed a narcotic drug with the intent to sell it.  Sentencing is scheduled for April 25, 2016.

SUSANNE JUDKINS, 21, of Machias, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Grand Larceny in the Fourth Degree, a class E felony.  The incident occurred between September 26, 2015 and October 3, 2015 in the Town of Allegany, when the defendant stole property and the value of the property exceeds one thousand dollars ($1,000.00).  Sentencing is scheduled for April 25, 2016.

RYAN LEWIS, 20, of Olean, New York, entered a plea of guilty to Burglary in the Third Degree,  a class D felony  and Criminal Mischief in the Fourth Degree, a class A misdemeanor, to satisfy a pending indictment.  The incident occurred on July 21, 2015 and July 24, 2015 in the City of Olean when the defendant knowingly entered or remained unlawfully in a dwelling with the intent to commit a crime therein and damaged property of another person in an amount exceeding $250.00.  Sentencing is scheduled for April 25, 2016.

KEVIN L. TODD, JR, 34, of Buffalo, New York, entered a plea of guilty  to Attempted Criminal Possession of a Controlled Substance in the Third Degree, a class C felony to satisfy a pending indictment.  The incident occurred on November 18, 2015, in the City of Olean, when Todd knowingly and unlawfully possessed a narcotic drug.  Further, KEVIN L. TODD, JR, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony, The incident occurred on or about July 24, 2015 in the City of Olean when the defendant knowingly and unlawfully attempted to sell a narcotic drug, to wit, crack cocaine. Sentencing is scheduled for May 23, 2016.

Sentences

DANIEL A. PRICE, 30, presently incarcerated in the Groveland Correctional Facility, was sentenced to a term of five years plus three years post release supervision with the New York State Department of Corrections and restitution for his conviction to Criminal Sale of a Controlled Substance, class B felonies and Criminal Possession of a Controlled Substance, class B felony.  The incident occurred on or about January 2, 2015, in the City of Olean, when the defendant sold a narcotic drug. 

ALEX L. SCHUMAKER, 23, of Springville, New York, but presently incarcerated, entered pleas of guilty to  Burglary in the Third Degree, a class D felony and Grand Larceny in the Fourth  Degree, a class E felony, to satisfy a pending indictment. The defendant was also sentenced to a term 1 year local in the Cattaraugus County Jail to run concurrent and restitution. The incident occurred on April 30, 2015, in the Town of East Otto, when the defendant knowingly entered or remained unlawfully in a dwelling with intent to commit a crime therein and stole property and the value of the property was more than $3,000.

RICHARD L. BARNETT, JR., 24, of Erie, Pennsylvania, but presently incarcerated in the Cattaraugus County Jail,  was sentenced to a term of 1 year in the Cattaraugus County Jail for his conviction to Attempted Criminal Possession of a Controlled Substance in the Third Degree, class C felony.  The incident occurred on May 1, 2015, in the City of Olean, when the defendant knowingly and unlawfully attempted to possess a narcotic drug with intent to sell it.
