Livingston Sheriff's Office cracks down on social media accounts for sex offenders

GENESEO- Sheriff Thomas J. Dougherty reports the arrest of several New York State Registered Sex Offenders on felony level charges following investigations by the Livingston County Sheriff’s Office over the last several weeks.
New York State Registered Sex Offenders are required by New York State Corrections Law that they register with the division no later than ten calendar days after any change of address, internet accounts with internet access providers belonging to such offender, internet identifiers that such offender uses, or his or her status of enrollment, attendance, employment or residence at any institution of higher education.  The charge is Failure to Register and to Verify.  
The first time that a New York State Sex Offender violates the law, it is a Class E Felony and after they have been convicted of that charge once, any further violation of the law is a Class D Felony.

Daniel Zambito, age 33 of Leicester was arrested on February 18th for Failure to Register and to Verify.  It is alleged that Zambito had a Facebook account that was not registered with the New York State Sex Offender Registry.   Zambito was arrested and arraigned in Geneseo Village Court before Judge Houston and remanded to the Livingston County Jail on $500 cash bail or $1,000 bond. 

David Beach, age 33 of Conesus was arrested on February 11th for Failure to Register and to Verify.  It is alleged that Beach had a Facebook account that was not registered with the New York State Sex Offender Registry.  Beach was arrested and arraigned in Geneseo Village Court before Judge Bushnell and remanded to the Livingston County Jail on $1,000 cash bail or $2,000 bond.

Joseph Shultis, age 29 from Mount Morris was arrested on February 22nd for Failure to Register and to Verify.  It is alleged that Shultis had a Facebook account and an email address that was not registered with the New York State Sex Offender Registry.  Shultis was arrested and arraigned in Geneseo Village Court before Judge Bushnell and remanded to the Livingston County Jail on $1,000 cash bail or $2,500 bond.

Stefan Halbrook, age 35 of Lima was arrested on February 11th for Failure to Register and to Verify.  It is alleged that Halbrook had a Facebook account that was not registered with the New York State Sex Offender Registry.  Halbrook was arrested and arraigned in Geneseo Village Court before Judge Houston and remanded to the Livingston County Jail on $1,000 cash bail or $2,000 bond.

William Bertch, age 43 of Mount Morris was arrested on January 25th for Failure to Register and to Verify.  It is alleged that Bertch had a Facebook account that was not registered with the New York State Sex Offender Registry.  Bertch was arrested and arraigned in Geneseo Village Court before Judge Bushnell and remanded to the Livingston County Jail on no bail based upon prior felony convictions. 
All investigations and arrests were handled by Investigator Dan Rittenhouse of the Sheriff's Office's Criminal Investigation Division.   Investigator Rittenhouse has also turned over several more investigations to local police departments with Sex Offenders residing within their local jurisdictions that may have also violated the New York State Corrections Law.  Also, more arrests are pending with the Sheriff's Office in regards to other New York State Registered Sex Offenders who may be violating the Corrections Law. 

“Your Sheriff’s Office is continuing to monitor and aggressively pursue sex offenders that are not following court mandated rules and that includes online accounts and behaviors,” stated Sheriff Dougherty.   “Convicted sex offenders trolling around on social media sites without proper oversight by police agencies, creates a very dangerous situation.   We will continue to actively keep these offenders in check and our children safer through social media compliance, investigations and arrests.”
