Call to Order: The meeting was called to order at 11:04 a.m. by Public Safety Committee Chairman Phil Curran.
Approval of Minutes
A motion was made by Legislator Hopkins, seconded by Legislator  Healy,  and carried to approve the Public Safety Committee minutes of March 2, 2016.
Public Defender
Monthly Report

            Public Defender Barbara Kelley pre-filed her monthly report.

            Ms. Kelley stated there are new eligibility guidelines coming out from NYS that will determine who is eligible for services from the Public Defender’s Office.   Ms. Kelley gave a highlight of the sixty plus page document and stated they will be required to offer Public Defender services to anybody who is 250 percent above poverty level.  She does expect that once this goes into effect it will be difficult to turn anybody down.  She also stated that a spouse’s salary does not have to be included in the thresholds.
Emergency Management and Fire
Monthly Report

            Director Jeff Luckey pre-filed his monthly report.

            He is working on bringing a program to the Genesee Valley School with first responders and working with law enforcement along with Cattaraugus County and Sheriff Offices and all parties involved with the Active Shooters Drill. 

            Mr. Luckey is seeking authorization to apply for the Homeland Security and Emergency Services LEMPG FY 2016 Grant.  The period of performance is October 1, 2015, through September 30, 2017, with an application due date of May 6, 2016.  The award amount is

$23,335.  The request was approved on a motion by Legislator Healy, seconded by Legislator McGraw, and carried.  Refer to Ways & Means.

            Mr. Luckey is also seeking authorization to apply for the Homeland Security and Emergency Services SHSP FY2016 grant.  The period of performance is September 1, 2016, through August 31, 2019, with an application due date of March 29, 2016.  The award amount is

$52,500.  The request was approved on a motion by Legislator Healy, seconded by Legislator McGraw, and carried.  Refer to Ways & Means.

STOP-DWI
Monthly Report

            Coordinator Linda Edwards pre-filed her monthly report.

            Ms. Edwards explained that the bicycle grant rules and regulations have changed.  She can no longer give away promotional items such as helmets, safety items, or reflective stickers.  This grant will only let her purchase educational information. 

            Ms. Edwards wanted to inform the Legislators that her victim impact numbers are increasing dramatically.  We are receiving a lot of referrals from Olean City Court.  Ms. Edwards wanted to know if we want to treat out-of-county referrals differently.  Legislators agreed that a fee of $40 should be charged for all out-of-county referrals.

            A motion made by Legislator Healy, seconded by Legislator McGraw, and carried to implement a $40 fee for out-of-county referrals.  Brenda Rigby Riehle stated that we will need to request a date for a public hearing as the change will require a local law.  County Attorney Minor stated that he would like to use a later Board date to introduce the resolution.  Motion to request a resolution to set a date for a public hearing was made by Legislator Healy, seconded by Legislator Hopkins, and carried.  Prepare Resolution
Probation

Monthly Report

            Director Bob Starks pre-filed his monthly report.

            Mr. Starks is requesting to accept the NYS Executive Law Article 13-A classification/ATI Service Plan Application 2016-17 contract renewal.  This contract renewal will allow for continued partial funding from the NYS Division of Criminal Justice Services for his department’s Community Service and Pre-Trial Programs.  The local County share for these programs is $68,740 and the total grant is for $5,998.

            A motion was made by Legislator McGraw, seconded by Legislator Hopkins, and carried to accept this grant.  It was noted that the funds have already been budgeted under A3142.101 (Alternatives to Incarceration – Personnel).  Prepare Resolution

Weights & Measures
Monthly Report
            Director Gilbert Green pre-filed his monthly report.

            Mr. Green was asked about the storage concerns he had with his trailers.  He said the trailers are still being stored at the Cooperative Extension buildings storage garage.
Sheriff’s Office
Monthly Report

            Sheriff Rick Whitney pre-filed his monthly report.

            Legislator Healy stated he toured the 911 center, and he had a few concerns about the lack of space.  Sheriff Whitney said he was OK with the space they have now.           

            The Sheriff’s Office is asking for approval to enter into a contract with NYS Department of Correctional Services Office of Nutritional Services to procure food products for the period of July 1, 2016, through June 20, 2021.  This contract will replace an existing contract that expires on June 30, 2016.  A motion to accept the contract was made by Legislator McGraw, seconded by Legislator Hopkins, and carried.  Prepare Resolution

            The Sheriff’s Office is seeking approval to renew the contract with AK Associates to provide E-911 database/phone line service to the E-911 Dispatch Center for the period of five years starting May 1, 2016.  A motion to accept this contract was made by Legislator Healy,  seconded by Legislator McGraw, and carried.  Prepare Resolution

            Sheriff Whitney wanted to reintroduce Resolution Intro. No. 76-16 with Schuyler County which was tabled for further discussion at the March 14 Board meeting.  A motion was made by Legislator Healy and seconded by Legislator Hopkins to open this up for discussion.  Sheriff Whitney stated this is not a mutual aid contract but a contract with another county.

            A motion was made by Chairman Crandall, seconded by Legislator LaForge, and carried to go into an attorney/client session.  Immediately following discussion a motion was made by Legislator Hopkins, seconded by Legislator Healy, and carried to come out of attorney client session. 

Adjournment
            There being no further business to come before the committee, the meeting was adjourned at 11:55 following a motion by Legislator Hopkins, seconded by Legislator Burt, and carried.
