Cattaraugus County District Attorney Report

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Tuesday, April 19, 2016:

SUZANNE E. RANDOLPH-BROOKS, 25, of Franklinville, New York, was arraigned and entered a plea of not guilty to an indictment that charges her with 12 counts of Forgery in the Second Degree, class D felonies. Prosecutors said she allegedly forged checks that did not belong to her.  The matter has been adjourned for motions.

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, April 18, 2016:

Arraignments
ARTHUR J. WRIGHT, 36, of Randolph, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Failure to Register, a class D felony.  The incident occurred on November 2, 2015, in the Town of Randolph, when Wright, a Level III sex offender, allegedly failed to personally verify his address with the local law enforcement agency every 90 days.  The matter has been adjourned for motions.
KRISTIAN P. GORDON-SMITH, 29, of Hinsdale, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Failure to Register, a class E felony.  The incident occurred on December 5, 2015, in the City of Olean, when Gordon-Smith, a registered sex offender, allegedly failed to notify the Division of Criminal Justice Services within ten days after a change of address.  The matter has been adjourned for motions.
MICHAEL A. OSBY, JR., 30, of Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with two counts of Grand Larceny in the Fourth Degree, class E felonies and two counts of Petit Larceny, class A misdemeanors.  The crimes occurred on September 24, 2015, in the City of Olean, when Osby allegedly stole two credit cards.  The matter has been adjourned for motions.
Guilty Pleas

STEVEN HOLT, 39, of Olean, New York, entered a plea of guilty to Attempted Criminal Possession of a Controlled Substance in the Third Degree, a class C felony.  The incident occurred on November 18, 2015, in the City of Olean, when he knowingly and unlawfully attempted to possess a narcotic drug.  Sentencing is scheduled for June 20, 2016. 

DEBRA M. DAVIS, 57, of Delevan, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Unlawful Manufacture of Methamphetamine in the Third Degree, class E felony.  The incident occurred on March 17, 2016, in the Town of Machias, when she attempted to manufacture methamphetamine.  Sentencing is scheduled for June 20, 2016. 

DAVID E. MOHR, 34, of Cattaraugus, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, class E felony.  The incident occurred on January 1, 2016 in the Town of New Albion, when he operated a motor vehicle in an intoxicated condition, having a .24 % BAC.  Sentencing is scheduled for June 20, 2016.

DANIE P. KLEIN, 26, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Assault in the Third Degree, a class A misdemeanor.  The crime occurred on February 9, 2016 in the City of Olean, when Klein recklessly caused physical injury to another person.  Sentencing is scheduled for June 20, 2016.

RACHEL L. SCHINDLER, 28, of Perrysburg, New York, entered a plea of guilty to Attempted Assault in the Second Degree, a class E felony to satisfy a pending indictment.  The incident occurred on June 11, 2015, when the defendant, with intent to cause physical injury, attempted to cause such injury to such person by means of a deadly weapon or a dangerous instrument.  Sentencing is scheduled for June 20, 2016.
Sentences

BRYCE C. STAHLMAN, 21, of Killbuck, New York, was sentenced to one year in the Cattaraugus County Jail for his conviction of Assault in the Third Degree, a class A misdemeanor.  The incident occurred on December 29, 2013, in the City of Salamanca, when Stahlman, with intent to cause physical injury to another person, caused such injury to such person or to a third person.
