Cattaraugus County District Attorney Report - April 25, 2016

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, April 25, 2016:

Arraignments
THOMAS E. CLOUSE, 23, of Arcade, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Aggravated Driving While Intoxicated, a class E felony; Driving While Intoxicated, a class E felony; Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree, a class E felony; Ignition Interlock Violation, a violation; Speeding in Zone, a violation.  The incident occurred on November 7, 2015, in the Town of Yorkshire. The matter has been adjourned for motions.
Guilty Pleas
DAVID F. JOHN, JR., 29, of Collins, NY, entered a plea of guilty to Assault in the Third Degree to satisfy a pending indictment.  The incident occurred on July 29, 2015, in the Town of Persia, when John entered or remained unlawfully in a building, intended to cause serious physical injury to another person while knowingly acting in a manner likely to be injurious to a child less than seventeen years old.  Sentencing is scheduled for July 25, 2016.

GUNNAR DOLE, 24, of Gowanda, New York, entered a plea of guilty to Criminal Possession of a Controlled Substance in the Seventh Degree, a class A misdemeanor to satisfy a pending indictment.  The incident occurred on September 25, 2015, in Gowanda, when Dole knowingly and unlawfully possessed and sold a narcotic drug.   Sentencing is scheduled for June 27, 2016.

BRENNAN D. SMITH, 26, of Olean, New York, entered a plea of guilty to two counts of felony Burglary to satisfy  an indictment. The incidents occurred on July 25, 2015, in the City of Olean and January 15, 2016, in the Town of Allegany, when the defendant knowingly entered or remained unlawfully in a building with the intent to commit a crime therein.  Sentencing is scheduled for July 11, 2016.

BRIDGET BARDO, 33, of Salamanca, New York, entered a plea of guilty to Criminal Sale of a Controlled Substance in the Fifth Degree to satisfy a pending indictment.  The incident occurred on July 31, 2015, in the City of Salamanca, when she knowingly and unlawfully possessed and sold a narcotic drug.  Sentencing is scheduled for June 27, 2016.

DUSTIN R. QUICK, 24 of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Criminal Mischief in the Third Degree, a class E felony and Assault in the Third Degree, a class A misdemeanor.  The incident occurred on February 19, 2016 in the City of Olean, when the defendant, with intent to cause physical injury to another person and having no right to do so nor any reasonable ground, damaged property of another person.  Sentencing is scheduled for June 27, 2016.

THOMAS V. LEWIS, 25, of Salamanca, New York, entered a plea of guilty to Attempted Assault in the Second Degree, a class E felony to satisfy a pending indictment.  The incident occurred on May 9, 2014, in the City of Salamanca, during an investigation, when Lewis caused physical injury to a police officer and resisted arrest.  Sentencing is scheduled for June 27, 2016.

EDWARD CRAWFORD, 27, of Olean, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Fourth Degree and Criminal Possession of a Controlled Substance in the Fifth Degree, to satisfy a pending indictment.  The incident occurred on October 14, 2015, in the City of Olean. Sentencing is scheduled for May 15, 2017 upon successful completion of Drug Treatment Court.

JESSICA L. HOLLAND, 26, of Olean, New York, entered a plea of guilty to  2 counts of Criminal Sale of a Controlled Substance in the Fourth Degree and 2 counts of Criminal Possession of a Controlled Substance in the Fifth Degree, to satisfy a pending indictment.  The incidents occurred on May 21, 2015 and June 9, 2015, in the City of Olean. Sentencing is scheduled for May 16, 2017 upon successful completion of Drug Treatment Court.

RICHARD J. KOZLOWSKI, 30, of Little Genesee, New York, entered a plea of guilty to Driving While Intoxicated, class E felony to satisfy a pending indictment.  The incident occurred on September 23, 2015, in the City of Olean, when he operated a motor vehicle a BAC of .11%.  Sentencing is scheduled for May 15, 2017 upon successful completion of Drug Treatment Court.
Sentences
ADAM K. GERLAND, 26, of Cuba, New York,  was sentenced as a Predicate Felony Offender to a determinent term of 6 years and 1 ½ years post release supervision with the New York State Department of Corrections  for his conviction to Criminal Possession of a Controlled Substance in the Third Degree, class B felony.  The incident occurred on December 25, 2015 in the City of Olean, when the defendant knowingly and unlawfully possessed a narcotic drug with the intent to sell it. 

TERRY DECHOW, 49, of Randolph, New York, was sentenced to a term of 5 years probation; driver’s license revoked for 1 year; ignition interlock for 1 year and 1 year conditional discharge for his conviction to Driving While Intoxicated, a class E felony  and Refusal of Breath Screen, a violation.  The incident occurred on September 9, 2015 in the Town of Napoli when the defendant operated a motor vehicle on a public highway in an intoxicated condition and refused to submit a breath test to be administered. 

GARY C. COLEMAN, 26, of Olean, New York, was sentenced to a term of 5 years plus 3 years post release supervision with the New York State Department of Corrections and a mandatory state surcharge for his conviction to Attempted Criminal Possession of a Controlled Substance in the Third Degree, a class C felony.  The incident occurred on March 21, 2015, when he knowingly and unlawfully attempted to possess a narcotic drug with the intent to sell it. 

RICKY S. SCHWAB, 55, of Yorkshire, New York,  was sentenced to a term of 1 ½ to 3 years with the New York State Department of Corrections for his conviction to Attempted Burglary in the Third Degree, a class E felony.  The incident occurred on July 8, 2015 in the Town of Yorkshire, when he knowingly entered or remained unlawfully in a building with the intent to commit a crime therein and the value of the property exceeded $3,000.00. 

EDWARD D. PRINCE, 50, of Olean, New York, was sentenced as a Predicate Felony Offender to a term of 1 ½ to 3 years with the New York State Department of Corrections for his conviction to Offering a False Instrument for Filing in the First Degree, a class E felony.  The incident occurred on April 27, 2015, when the defendant knowingly falsified a statement with intent to defraud a public benefit corporation. 

TRAVIS M. GILBERT, 27, of Salamanca, New York, was sentenced a Predicate Felony Offender  to an indeterminate  term of 2 to 4 years with the New York State Department of Corrections and restitution for his conviction to Burglary in the Third Degree, a class D felony.  The incident occurred on December 8, 2015, in the City of Salamanca. 

SUSANNE JUDKINS, 32, of Machias, New York, was sentenced to a 1 year conditional discharge; 40 hours of community service and restitution for her conviction to Grand Larceny in the Fourth Degree, a class E felony.  The incident occurred on or about and between September 26, 2015 and October 3, 2015 in the Town of Allegany, when the defendant stole property and the value of the property exceeds one thousand dollars ($1,000.00).
