Livingston County: DWAI Drug Charge Following Near Miss With Police Cruiser

GENESEO:  Sheriff Thomas J. Dougherty reports the arrest of a Denver, Colorado resident for driving while ability impaired by drugs. On April 2, 2016 at approximately 9:30 p.m. Deputy Sheriff John Morgan stopped a vehicle on Mount Morris Road in the Town of Geneseo after the vehicle came within inches of striking two Geneseo Police cars that were on a traffic stop.  The female operator was identified as 19 year old Aspen B. Cowan.  A Sheriff’s STOP DWI Unit was requested to the scene.   Deputy Sheriff Brandan Flickner of the STOP DWI Unit arrived and requested Cowan to perform field sobriety tests.   At the conclusion of the field tests, Cowan was arrested for driving while ability impaired by drugs. Cowan was transported to the Livingston County Sheriff’s Office for a further drug evaluation.  At the conclusion of a drug evaluation, it was Deputy Flickner’s expert opinion as a Drug Recognition Expert that Cowan was under the influence of a Central Nervous System Stimulant and was unable to operate a vehicle safely. Cowan was charged with driving while ability impaired by drugs and failure to yield to emergency vehicles under New York State slow down and move over law. Cowan was turned over to Deputies at the Livingston County Jail for processing and arraignment.   Cowan was arraigned on April 3rd in Geneseo Town Court before Justice Presutti and held on $500 cash or $1000 bond. Deputies were assisted by the Geneseo Police Department on scene.
