Cattaraugus County District Attorney Report - May 9, 2016

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, May 9, 2016:
Arraignments:
AMANDA NENNO, 29, of Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges her with Criminal Possession of a Controlled Substance in the Third Degree and Criminal Sale of a Controlled Substance in the Third Degree, both class B felonies.  The incident occurred on March 11, 2016, in the City of Olean, when she allegedly and knowingly and unlawfully sold a narcotic drug.  The matter has been adjourned for motions.

CHELSEA LYONS, 26 of Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges her with Criminal Possession of a Controlled Substance in the Third Degree and Criminal Sale of a Controlled Substance in the Third Degree, both class B felonies.  The crime occurred on January 16, 2016, in the City of Olean, when she allegedly and knowingly and unlawfully sold a narcotic drug.  The matter has been adjourned for motions.

CHAD SIAGO, 44, of Allegany, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Burgarly in the Second Degree, a class C felony and Grand Larceny in the Fourth Degree, a class E felony.  The incident occurred on January 24, 2016, in the City of Olean, when Siago allegedly and knowingly entered or remained unlawfully in a dwelling with intent to commit a crime therein and stole property.  The matter has been adjourned for motions.

ANDREW USYK, 24, of Gowanda, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with two counts of Driving While Intoxicated, class E felonies and Failure to Keep Right, a violation.  The incident occurred on December 27, 2015, in the Town of Perrysburg, when the defendant allegedly operated a motor vehicle in an intoxicated condition, having a .10% BAC.  The matter has been adjourned for motions.

ANDREW WASHINGTON, 41, of Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Driving While Intoxicated, a class E felony; Aggravated Unlicensed Operation of a Motor Vehilce in the First Degree, a class E felony; Operating Without and Ignition Interlock Device, a violation and Failure to Stop at a Stop Sign, a violation.  The incident occurred on January 9, 2016, in the City of Olean. The matter has been adjourned for motions.

TAYLOR J. BORWN, 17, of Salamanca, New York, was arraigned and entered a plea of not guilty to an indictment that charges her with Grand Larceny in the Third Degree, a class D felony; Grand Larceny in the Fourth Degree, a class E felony; two counts of Driving While Intoxicated, misdemeanors; Criminal Mischief in the Fourth Degree, a class A misdemeanor; Speed Not Reasonable/Prudent, a violation and Failure to Stop , a violation.  The alleged crime occurred on February 10, 2016, in the City of Olean, when the defendant stole a vehicle and operated it while she was in an intoxicated condition, having a .11% BAC, at a speed not reasonable and crashed the motor vehicle, causing damage.  The matter has been adjourned for motions.

NICHOLAS BROOKS, 22, of Portville, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Rape in the Third Degree, a class E felony; Forcible Touching, a class A misdemeanor; Sex Abuse in the Third Degree, a class B misdemeanor and Endangering the Welfare of a Child, a class A misdemeanor.  The incident occurred on April 4, 2015, in the Town of Portville, when he allegedly engaged in sexual intercourse with another person who was less than 17 years old.  The matter has been adjourned for motions.

Guilty Pleas:
MARTINA RIVERA, 35, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Assault in the Second Degree, a class E felony.  The incident occurred on February 21, 2016, in the City of Olean, when the defendant attempted to cause physical injury to another person by means of a dangerous instrument.  Sentencing is scheduled for July 11, 2016.

KAITLYN N. COSSAIRT, 21, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of guilty to Attempted Burglary in the Third Degree, a class D felony, to satisfy a pending indictment.  The incident occurred on October 9, 2015, in the Town of Allegany, when the defendant knowingly attempted to enter or remain unlawfully in a building with intent to commit a crime therein. Sentencing is scheduled for July 18, 2016.
Sentences:
CHRISTOPHER D. BURTON, 27, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced as a predicate felon to a determinate term of eight years in the New York State Department of Corrections to be followed by a five year period of post-release supervision for his conviction of Burglary in the Second Degree, a class C felony.  The incident occurred between January 23, 2016 and January 28, 2016, in the City of Olean, when the defendant knowingly entered or remained unlawfully in a dwelling with intent to commit a crime therein.

DAMON L. MAULL, 30, of Olean, New York but presently incarcerated in the Cattaraugus County Jail, was sentenced to a determinate term of two years in the New York State Department of Corrections to be followed by a three year term of post-release supervision for his conviction of Attempted Criminal Possession of a Controlled Substance in the Third Degree, a class C felony.  The incident occurred on April 18, 2015, in the City of Olean, when he attempted to possess a narcotic drug with intent to sell it.
SEAN M. GALMER, 26, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced as a predicate felon to a determinate term of 1 ½ years in the New York State Department of Corrections to be followed by a two year period of post-release supervision for his conviction of Criminal Sale of a Controlled Substance in the Third Degree, class B felony.  The incident occurred on May 1, 2015 in the City of Olean, when Galmer sold a narcotic drug.  He was further sentenced to a concurrent term of 2 ½ years in the New York State Department of Corrections to be followed by a three year period of post-release supervision for his conviction of Criminal Possession of a Controlled Substance in the Fifth Degree.  The incident occurred on May 29, 2015, in the City of Olean, when the defendant knowingly and unlawfully possessed a narcotic drug.

RICHARD CUMMINGS, 28, of Olean, New York, was sentenced to four months in the Cattaraugus County Jail and five years probation for his conviction of Attempted Criminal Sale of a Controlled Substance in the Third Degree, class C felony.  The incident occurred on June 16, 2015, in the City of Olean, when the defendant knowingly and unlawfully attempted to sell a controlled substance.
