Livingston County District Attorney Report - May 10, 2016

After presentation by Joshua J. Tonra, Assistant District Attorney, the following cases were handled in the Livingston County Court before the Honorable Robert B. Wiggins on May 10, 2016.

JEREMY CAFFREY, age 33, formerly of Groveland Correctional Facility was sentenced on a conviction of Attempted Promoting Prison Contraband in the First Degree (E Felony) to 1 1/2 to 3 years' in state prison. He was also ordered to pay a $325 surcharge and a $50 DNA fee.

ANDREW L. CROWNER, age 28, of Wellsville was sentenced on a conviction of Criminal Possession of a Controlled Substance in the Fourth Degree (C Felony) to 4 months in jail and 5 years' probation to include drug treatment court. He was also ordered to pay a $375 surcharge, a $50 DNA fee, and his license was suspended.

BRENDALEE DUQUETTE, age 46, of Dansville was sentenced on a conviction of Falsifying Business Records in the First Degree (E Felony) to 1 1/2 to 3 years' in state prison. She was also ordered to pay a $375 surcharge and a $50 DNA fee.

FRANKLIN A. GAY, age 41, of Rochester, charged with Tampering with Physical Evidence (E Felony), appeared with his attorney and the matter was adjourned to May 31, 2016. Bail was set at $10,000.

BRIAN J. JONES, age 32, of Rochester was charged with Criminal Possession of a Controlled Substance in the Third Degree (B Felony), Resisting Arrest, Operating an Uninspected Motor Vehicle, and Light Transmittance Less Than 70 Percent, pled not guilty, and the matter was adjourned to May 17, 2016. His license was suspended pending prosecution.

TREVIN W. KELLEY, age 23, of Rochester was sentenced on a conviction of Attempted Burglary in the Second Degree (D Felony) to 3 years in state prison plus 5 years post-release supervision. He was also ordered to pay a $375 surcharge, a $50 DNA fee, and an Order of Protection was issued for the victim.

JAMES P. LEE, age 54, of Irondequoit was sentenced on a conviction of Aggravated Driving While Intoxicated (E Felony) to 6 months in jail and 5 years' probation. He was also ordered to pay a $2,000 fine, a $520 surcharge, a $50 DNA fee, and his license was revoked with a requirement to install an Ignition Interlock Device.

JOHN PATRICK MANN age 26, of Nunda pled guilty to Grand Larceny in the Fourth Degree (E Felony) and the matter was adjourned to July 5, 2016 for sentencing.

GABRIAL P. MARTINEZ-MOSES, age 48, of Livonia, charged with Criminal Possession of a Weapon Third Degree (D Felony), Aggravated Family Offense (D Felony), Criminal Obstruction Breathing or Blood Circulation (Misdemeanor), Resisting Arrest (Misdemeanor), and Criminal Mischief in the Fourth Degree (Misdemeanor), appeared with his attorney and the matter was adjourned to a later date. Bail was set at $10,000.

DUSTIN D. NEU, age 35, of Dansville, charged with two counts of Criminal Sale of a Controlled Substance in the Fourth Degree (C Felony) and two counts of Criminal Possession of a Controlled Substance in the Fifth Degree (D Felony), appeared with his attorney and the matter was adjourned to June 7, 2016.

MELCHIZEDEK ROGERS, age 25, of Geneseo, charged with Criminal Sale of a Controlled Substance in the Third Degree (B Felony) and Criminal Possession of a Controlled Substance in the Third Degree (B Felony), appeared with his attorney and the matter was adjourned to July 5, 2016. Bail was set at $10,000. ANTHONY C. VELASQUEZ, age 28, of Mt. Morris, charged with Criminal Sale of a Controlled Substance in the Third Degree (B Felony) and Criminal Possession of a Controlled Substance in the Third Degree (B Felony), appeared with his attorney and the matter was adjourned to July 5, 2016. Bail was set at $10,000.

MARK H. WILSON, JR. age 27, of Dansville was sentenced on a violation of probation to 1 year in jail.
