Cattaraugus County District Attorney Report - June 13, 2016

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, June 13, 2016:
Arraignments
CHRISTOPHER J. KOCHAN, 51, of Little Valley, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Obstructing Governmental Administration, a class A misdemeanor; Obstruction on Windshield, a violation; Driver’s View Obstructed, a violation, two counts of Failure to Keep Right; two counts of Failure to Signal Turn, two counts of Failure to Yield to an Emergency Vehicle, a violation; and No Headlights.  The charges contained in the indictment occurred on February 27, 2016, in the Towns of Mansfield and Little Valley.  The matter has been adjourned for motions.

CHRISTOPHER A. BARBER, 27, of Portville, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Grand Larceny in the Third Degree, a class D felony; and Criminal Possession of Stolen Property in the Third Degree, a class D felony.  The alleged incidents occurred on November 23, 2015, in the Town of Portville and December 2, 2015 in the City of Olean, when Barber allegedly stole and possessed stolen property and the property was valued at more than $3,000.  The matter has been adjourned for motions.

MIRAYA VANTINO, 25, of Gowanda, New York, was arraigned and entered a plea of not guilty to an indictment that charges her with Criminal Possession of a Controlled Substance in the Fifth Degree, class D felony; Criminal Using Drug Paraphernalia in the Second Degree, class A misdemeanor; Criminal Possession of a Controlled Substance in the Third Degree, a class B felony; Criminal sale of a Controlled Substance in the Third Degree, class B felony.  The crime occurred on September 25, 2015, in the City of Gowanda, when the defendant knowingly and unlawfully possessed and sold a narcotic drug and possessed material suitable for packaging individual quantities, packaging or dispensing of narcotic drugs or stimulants.  The matter has been adjourned for motions.

GARY HEINAMAN, 77, currently incarcerated in the New York State Department of Corrections, was arraigned and entered a plea of not guilty to an indictment that charges him with Burglary in the Second Degree, a class D felony; Criminal Possession of Stolen Property in the Fourth Degree, a class E felony; Petit Larceny, a class A misdemeanor and Possession of Burglary Tools, a class A misdemeanor.  The incident occurred on November 29, 2015, in the Town of Ellicottville, when he allegedly entered or remained unlawfully in a building with intent to commit a crime therein and stole property.  The matter has been adjourned for motions.

JOSHUA WROBEL, 28, of Holland, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with four counts of Burglary in the Second Degree, class C felonies; Grand Larceny in the Third Degree, a class D felony; two counts of Grand Larceny in the Fourth Degree, class E felonies; two counts of Criminal Mischief in the Fourth Degree, class A misdemeanors; four counts of Petit Larceny, class A misdemeanors; Criminal Possession of Stolen Property in the Third Degree, a class D felony and Driving While Ability Impaired by Drugs, a class E felony.  The incidents occurred December 31, 2015 through January 1, 2015, in the Towns of Ashford, Little Valley and Freedom, when he allegedly knowingly entered or remained unlawfully in dwellings with intent to commit crimes therein and stole property, some consisting of firearms.  The matter has been adjourned for motions.

DERRELL WASHINGTON, 24, of Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Assault in the Second Degree, a class D felony.  The incident occurred on or about January 10, 2016, in the City of Olean, when the defendant, with intent to cause physical injury to another person allegedly caused such injury by means of a deadly weapon or a dangerous instrument.  The matter has been adjourned for motions.

BRYANT GALMER, 28, of Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Third Degree and Criminal Sale of a Controlled Substance in the Third Degree, both class B felonies.  The incident occurred on January 16, 2016, in the City of Olean, when he allegedlyknowingly and unlawfully possessed and sold a narcotic drug.  The matter has been adjourned for motions.

Guilty Pleas
AARON M. GAYLOR, 26, of Portville, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to two counts of Grand Larceny in the Fourth Degree, class E felonies and Unlawful Fleeing a Police Officer in a Motor Vehicle in the Third Degree, a class A misdemeanor.  The first incident occurred on or about September 1, 2015, in the Town of Portville when the defendant stole one or more firearms.  The second incident occurred during November 2015, in the Town of Allegany, when the defendant stole property and the value of the property exceeded $1,000 and the third incident occurred on or about November 24, 2015, in the Town of Portville when the defendant, after being directed to stop his motor vehicle by a uniformed police officer or marked police vehicle by the activation of either the lights or the lights and the siren, he attempted to flee such officer by driving at speeds which equal or exceed 25 miles per hour above the speed limit or engaged in reckless driving.  Sentencing has been scheduled for July 17, 2017.

SCOTT E. BABB, 22, of Hinsdale, New York, entered a plea of guilty to rape in the Third Degree, a class E felony, to satisfy a pending indictment.  The incident occurred between August 2015 and December 2015, in the Town of Hinsdale, when the defendant, being 21 years old or more, engaged in sexual intercourse with a person who was less than 17 years old.  Sentencing is scheduled for August 15, 2016.

MICHAEL PECK,25, of Gowanda, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to one count of Attempted Criminal Sale of a Controlled Substance in the Fourth Degree, a class D felony.  The incident occurred on February 23, 2016, in the Town of Persia, when he knowingly and unlawfully attempted to sell a narcotic preparation.  Sentencing is scheduled for September 19, 2016.

Sentences
DONNELL PARRISH, 27, of Olean, New York, was sentenced to five years probation for his conviction of Criminal Sale of a Controlled Substance in the Fourth Degree, a class D felony.  The incident occurred on October 29, 2015, in the City of Olean, when the defendant knowingly possessed and sold a narcotic drug.

CORDERO J. RUMPH, a/k/a GWAP, 30, of Bronx, New York, was sentenced as a predicate felon to determinate term of 4 ½ years in the New York State Department of Corrections to be followed by a two year period of post-release supervision for his conviction of Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony.  The incident occurred on January 9, 2015, in the Town of Allegany, when he knowingly and unlawfully attempted to sell a narcotic drug.  He was also sentenced to a concurrent 2-4 year term for his conviction of Burglary in the Third Degree, as well as, a one year term for his conviction of Petit Larceny.  The incident occurred on December 25, 2014, in the City of Olean, when the defendant knowingly entered or remained in a building with intent to commit a crime therein and stole property.

DONOVAN ABRAMS, 46, of Salamanca, New York, was sentenced to five years probation, four months of weekend work program, his license was revoked for one year and he was ordered to wear a SCRAM bracelet for 90 days for his conviction of Driving While Intoxicated, a class D felony.  The incident occurred on October 8, 2015, in the City of Salamanca, when the defendant when the defendant operated a motor vehicle on a public highway with a BAC of .23%. 

TRACY MCGRAW, 27, of Wellsville, New York, was sentenced to five years probation and ordered to pay restitution for his conviction of Grand Larceny in the Fourth Degree, a class E felony.  The incident occurred between August 2015 and October 2015, in the City of Olean, when the defendant stole property and the value of the property exceeded $1,000. 

JOSHUA M. WEIGARTZ,30, of Olean, New York, was sentenced as a predicate felon to 1 ½-3 years in the New York State Department of Corrections for his conviction of Attempted Burglary in the Third Degree, a class E felony and he was sentenced to a concurrent one year term for his conviction of Criminal Contempt in the Second Degree, a class A misdemeanor.  The incident occurred on March 1, 2016, in the City of Olean, when the defendant attempted to knowingly enter or remain unlawfully in a building with intent to commit a crime therein and intentionally disobeyed or resisted the lawful process or other mandate of a court.

JAMES KORBAR, 54, of Gowanda, New York, was sentenced as a predicate felon to a determinate term of 1 ½ years in the New York State Department of Corrections, to be followed by 1 year of post-release supervision for his conviction of Attempted Unlawful Manufacture of Methamphetamine in the Third Degree, class E felony.  The incident occurred on or about February 4, 2016, in the Town of Persia, when the defendant attempted to manufacture methamphetamine.

DEBRA M. DAVIS, 57, of Delevan, New York, was sentenced as a predicate felony to a determinate term of 2 years in the New York State Department of Corrections, to be followed by 2 years of post-release supervision for her conviction of Attempted Unlawful Manufacture of Methamphetamine in the Third Degree, class E felony.  The incident occurred on March 17, 2016, in the Town of Machias, when the defendant attempted to manufacture methamphetamine.

JOHN H. ECCLES, 45, of Portville, New York, was sentenced to six months in the Cattaraugus County Jail for his conviction of Failure to Register or Verify As A Sex Offender, a class E felony.  The incident occurred on March 25, 2015, in the Town of Portville, when the defendant, a registered sex offender, knowingly failed to complete and return the annual verification from to the Division of Criminal Justice Services within 10 days. 

AARON R. TIERSON, 33, of Cuba, New York, was sentenced to five years probation and ordered to pay restitution for his conviction of Grand Larceny in the Fourth Degree, a class E felony.  The incident occurred on May 2010 to December 2013, when the defendant stole property in excess of $1,000.
