Cattaraugus County District Attorney Report for June 27, 2016

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, June 27, 2016:

Arraignments
LENNY A. PENA, 20, of Olean, New York, but presently in the Cattaraugus County Jail was arraigned and entered a plea of not guilty to an indictment that charges him with 2 counts of Assault in the Second Degree, class D felonies.  The incident occurred on March 11, 2016, in the City of Olean when the Pena allegedly intended to cause serious physical injury to a person who is 65 years of age or older.  LENNY A. PENA, also was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Mischief in the Second Degree, a class D felony; Obstruction of Governmental Administration in the Second Degree, a class A misdemeanor and 2 counts of Harassment in the Second Degree, violations.  The incident occurred on April 10, 2016, in the City of Olean when the allegedly and intentionally damaged property of another person exceeding $250, intentionally prevented the administration of law or prevented a public servant from performing an official function by means of interference and did subject such other person to physical contact.  The matter has been adjourned for motions.

RICKY L. ARMSTRONG, 36, of Salamanca, New York, but presently in the Cattaraugus County Jail was arraigned and entered a plea of not guilty to an indictment that charges him with Resisting Arrest, a class A misdemeanor; 2 counts of Aggravated Family Offense, class E felonies; 3 counts of Criminal Contempt, class E felonies and Stalking in the Fourth Degree, a class B misdemeanor.  The incident occurred in January 2016, in the City of Salamanca when the allegedly intentionally resisted arrest, violated an order of protection and caused reasonable fear to the physical health of another person.  The matter has been adjourned for motions.

BERRY ARMPRESTER, 69, of Olean, but presently in the Cattaraugus County Jail was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Third Degree,  a class B felony and Criminal Sale of a Controlled Substance in the Third Degree, a class B felony.  The incident occurred on November 4, 2015, in the City of Olean when the defendant allegedly possessed and sold a narcotic drug.  The matter has been adjourned for motions.
Guilty Pleas
LOGAN SHEARER, 20, of Olean, New York, entered a plea of guilty to Criminal Trespass in the Second Degree, a class A misdemeanor to satisfy a pending indictment.  The incident occurred on December 27, 2015, in the Town of Allegany when the defendant knowingly entered or remained unlawfully in a dwelling.  Sentencing is scheduled for August 29, 2016.

DANIEL T. WILSON, 39, of Hinsdale, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of guilty to Burglary in the Third Degree, a class D felony  and Criminal Possession of a Weapon in the Third Degree, a class D felony to satisfy a pending indictment.  The incident occurred between May 8-May 14, 2016, in the Town of Hinsdale, when the defendant knowingly entered or remained unlawfully in a building, with intent to commit a crime and possessed a firearm.  Sentencing is scheduled for August 29, 2016.

DANIEL P. KLEIN, 26, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of guilty to Burglary in the Third Degree, a class D felony to satisfy a pending indictment.  The incident occurred on June 1, 2016, in the Town of Persia, when the defendant knowingly entered or remained unlawfully in a building with intent to commit a crime.  Sentencing is scheduled for August 29, 2016.

MICHAEL C. LATHROP, 25, of Delevan, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of guilty to Attempted Unlawful Manufacture of Methamphetmines, a class D felony to satisfy a pending indictment.  The incident occurred on April 9, 2016, in the Town of Freedom, when the defendant attempted to possess and intend to unlawfully manufacture methamphetamine.  Sentencing is scheduled for August 29, 2016.

TIFFANLY L. CHIARILLI, 38, of Cuba, New York, but presently incarcerated in the Cattaraugs County Jail, entered a plea of guilty to Driving While Intoxicated, a class E felony to satisfy a pending indictment.  The incident occurred on January 27, 2016, in the Town of Yorkshire, when the defendant operated a motor vehicle on a public highway in an intoxicated condition.  Sentencing is scheduled for July 24, 2017. (The date is correct. Chiarilly will enter treatment).

THOMAS E. CLOUSE,  of Arcade, New York, entered a plea of guilty to Driving While Intoxicated, a class E felony to satisfy a pending indictment.  The incident occurred on November 7, 2015, in the Town of Yorkshire, when the defendant operated a motor vehicle on a public highway in an intoxicated condition.  Sentencing is scheduled for July 24, 2017.

Sentences

THOMAS V. LEWIS, 25, of Salamanca, New York, was sentenced to a term of 1 to 3 years with the New York State Department of Corrections for his conviction  to  Attempted Assault in the Second Degree, a class E felony.  The incident occurred on May 9, 2014, in the City of Salamanca, during an investigation, caused physical injury to a police officer and resisted arrest.

CJ ANDREW WOLF, 25, of Niagara Falls, New York, was sentenced to a term of 60 days in the Cattaraugus County Jail and 10 years probation for his conviction to Rape in the Third Degree, a class E felony.  The incident occurred on December 6, 2015, in the Town of Salamanca, when the defendant, being 21 years or older, engaged in sexual intercourse with a person less than 17 years old. 

JOSEPH TYLER, 27, of Dayton, New York, was sentenced to a term of 10 years probation for his conviction  to Rape in the Third Degree, a class E felony.  The incident occurred on August 11, 2015 in the Town of Dayton, when the defendant being twenty-one year old or more, engaged in sexual intercourse with another person less than seventeen years old.

KYLE CLAYPOOL, 29, of Salamanca, New York, was sentenced to a 1 year Conditional Discharge for his conviction to Criminal Possession of Stolen Property in the Fifth Degree.  The incident occurred on July 28, 2015, in the City of Salamanca, when the defendant knowingly possessed stolen property and the value of the property exceeded $3,000.

BRIDGET BARDO, 33, of Salamanca, New York, was sentenced to a term of 2 years with the New York State Department of Corrections and 1 year of post release supervision for her conviction to Criminal Sale of a Controlled Substance in the Fifth Degree.  The incident occurred on July 31, 2015, in the City of Salamanca, when the defendant knowingly and unlawfully possessed and sold a narcotic drug.
