Olean: Court says 'too bad, so sad' to Olean convicted felon

A state court has rejected an appeal from an Olean who disputed the label of ‘predicate felon’ and the sentence by a Cattaraugus County Judge. David Benson, who was 45 when a judge sent him to state prison for selling drugs, has lost his appeal. Although the court agreed with some of Benson’s claims…in the end, the Appellate Court said it rejects Benson’s challenge to the severity of the sentence. Granted, in the decision there was plenty of legal talk…the bottom line is…the sentence and label stands.
