Cattaraugus County District Attorney report - Aug. 29, 2016

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, August 29, 2016:

Arraignments:

SKYLER A. CARLSON, 18, of Shinglehouse, Pennsylvania, was arraigned and entered a plea of not guilty to an indictment that charges him with 2 counts of Rape in the First Degree, class B felonies; Rape in the Third Degree, a class E felony; Criminal Sexual Act in the First Degree, a class B felony and Unlawful Imprisonment in the Second Degree, a class A misdemeanor.  The incident occurred on June 25, 2016, in the Town of Allegany, when Carlson allegedly had sexual intercourse with another person by forcible compulsion.  The matter has been adjourned for motions.

ROBERT J. DEPPA, 32, of Redhouse, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with 2 counts of Criminal Possession of a Controlled Substance in the Fifth Degree, class B felonies and 2 counts of Criminal Sale of a Controlled Substance in the Fifth Degree, class B felonies.  The crime occurred on January 15, 2015, in the City of Salamanca, when Deppa allegedly knowingly and unlawfully possessed and sold a narcotic drug.  The matter has been adjourned for motions.

ROBERT L. NELSON, 46, of Portville, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with 2 counts of Menacing a Police Officer, class D felonies; Criminal Mischief in the Fourth Degree, a class A misdemeanor; Menacing in the Second Degree, a class A misdemeanor; Disorderly Conduct, a violation and Resisting Arrest, a violation.  The incident occurred on May 16, 2016, in the City of Olean, when Nelson allegedly attempted to place a police officer in reasonable fear while displaying a knife; intentionally damaged property of another person; intended to cause a public annoyance and resisted arrest.  The matter has been adjourned for motions.

AMOS J. KRAUSE, 31, of Salamanca, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Third Degree, a class B felony and Criminal Sale of a Controlled Substance in the Third Degree, a class B felony.  The incident occurred on June 29, 2016, in the City of Salamanca, when Krause allegedly knowingly and unlawfully possessed and sold a narcotic drug.  The matter has been adjourned for motions.

JOHN LEE, 42, Salamanca, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Third Degree, a class B felony and Criminal Sale of a Controlled Substance in the Third Degree, a class B felony.  The incident occurred on February 12, 2015, in the Town of Great Valley, when the defendant knowingly and unlawfully possessed and sold a narcotic drug.  The matter has been adjourned for motions.

REGINALD IRION, 57, of Gowanda, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with 2 counts of Criminal Possession of a Controlled Substance in the Fifth Degree, class B felonies and 2 counts of Criminal Sale of a Controlled Substance in the Fifth Degree, class B felonies.  The incident occurred in November 2015 in the Town of Persia when he allegedly and unlawfully possessed and sold a narcotic drug.  The matter has been adjourned for motions.

Guilty Pleas:

ANDREW USYK, 25, of Gowanda, New York, entered a plea of guilty to Driving While Intoxicated, a class E felony to satisfy a pending indictment.  The incident occurred on December 27, 2015, in the Town of Perrysburg, when he operated a motor vehicle in an intoxicated condition, having a .10% BAC.  Sentencing is scheduled for October 31, 2016.

JESSICA CORBETT, 29, of Hinsdale, New York, entered a plea of guilty to Criminal Sale of a Controlled Substance in the Third Degree,a class B felony to satisfy a pending indictment.  The incident occurred on July 29, 2015, in the City of Olean, when she sold a narcotic drug.  Sentencing is scheduled for October 23, 2017.

Sentences:

DANIEL T. WILSON, 39, of Hinsdale, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to a term of 6 years with the New York State Department of Corrections and 5 years post release supervision AND a term of 2 to 4 years with the New York State Department of Corrections, to run consecutively, for his convictions to Criminal Possession of a Weapon in the Third Degree, a class D felony  and Burglary in the Third Degree, a class D felony.  The incident occurred between May 8-May 14, 2016, in the Town of Hinsdale, when he knowingly entered or remained unlawfully in a building, with intent to commit a crime and possessed a firearm.

MICHAEL C. LATHROP, 25, of Delevan, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to 1 ½ years with the New York State Department of Corrections and 1 year of post release supervision for his conviction to Attempted Unlawful Manufacture of Methamphetamine, a class D felony.  The incident occurred on April 9, 2016, in the Town of Freedom, when the defendant attempted to possess and intend to unlawfully manufacture methamphetamine. 

SELENA M. HARE, 24, of Randolph, New York, but presently incarcerated in the Bedford Hills Correctional Facility, was sentenced to 2 to 4 years with the New York State Department of Corrections for her conviction to Attempted Burglary in the Third Degree, a class E felony.  The incident occurred on February 12, 2015, in the Town of Randolph, when the defendant knowingly attempted to enter or remain unlawfully in a building with intent to commit a crime therein. 

LOGAN SHEARER, 20, of Olean, New York, was sentenced to a 1 year Conditional Discharge for his conviction to Criminal Trespass in the Second Degree, a class A misdemeanor to satisfy a pending indictment.  The incident occurred on December 27, 2015, in the Town of Allegany when Shearer knowingly entered or remained unlawfully in a dwelling.

ELI CLARK, 25 of Buffalo, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Unauthorized Use of a Vehicle in the Third Degree, a class A misdemeanor and was sentenced as time served.  The incident occurred on April 13, 2016,  in the Town of Franklinville, when the defendant knowingly took and operated a motor vehicle without the owner’s consent.
