Cattaraugus County District Attorney Report - Jan., 2017

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, January 9, 2017:
Arraignment
MARY P. ERHART, 36, no permanent address, was arraigned and entered a plea of not guilty to an indictment that charges her with Criminal Sale of a Controlled Substance in the Third Degree, a class B felony.  The incident occurred on September 17, 2016, in the City of Olean, when she allegedly knowingly and unlawfully sold a controlled substance.  The case has been adjourned for motions.

NATHAN C. BILBY, 25, of Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with two count of Grand Larceny in the Fourth Degree, class E felonies and seven counts of Petit Larceny, class A misdemeanors.  The incidents occurred on August 20, 2016, in the City of Olean, when the defendant allegedly stole property.  The matter has been adjourned for motions.
RYAN P. WILLIS, 33, of Portville, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with 2 counts of Unlawful Manufacture of Methamphetamine in the Third Degree, class D felonies; Criminal Possession of Methamphetamine Materials in the Second Degree, a class A misdemeanor and Criminal Possession of a Controlled Substance in the Second Degree, a class A-II felony.  The incident occurred on July 29, 2016, in the Town of Portville, when Willis allegedly knowingly and unlawfully possessed materials to produce, prepare or manufacture methamphetamine.  The matter had been adjourned for motions.
Guilty Pleas
MAURICE ARNOLD, 29, of Hinsdale, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony, to satisfy a pending indictment.  The incident occurred on June 21, 2016, in the City of Olean, when the defendant attempted to knowingly and unlawfully sell a controlled substance.  Sentencing is scheduled for March 13, 2017.

RACHEL SLAWIAK, 26, of Olean, New York, entered a plea of guilty to Criminal Sale of a Controlled Substance in the Fourth Degree, a class C felony to satisfy a pending indictment.  The incident occurred on January 8, 2016, in the City of Olean, when she knowingly and unlawfully sold a controlled substance.  Sentencing is scheduled for March 13, 2017.

ANDREA STANCZYKOWSKI, 29 of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony.  The incident occurred on May 31, 2016, in the Town of Olean, when she knowingly and unlawfully attempted to sell a controlled substance.  Sentencing is scheduled for January 18, 2018.
Sentences
RYEN T. PUTT, 25, of Olean, New York, was sentenced to 12 weekends in the Cattaraugus County Jail and 5 years probation for his conviction to two counts of Grand Larceny in the Fourth Degree, class E felonies.  The incidents occurred on between July 3, 2016 and July 13, 2016, in the Town of Portville, when the defendant stole property and the property consisted of one or more firearms, rifles or shotguns. 

JEFFREY BURNEY, 22, of Olean, New York, was sentenced to 60 days in the Cattaraugus County Jail and 3 years probation for his conviction to Assault in the Third Degree, a class A misdemeanor.  The incident occurred on March 11, 2016, in the City of Olean, when the defendant, along with a co-defendant, with intent to cause physical injury to another person, caused such injury to such person. 

ALLEN E. BRILLHART, 31, of Silver Creek, New York, was sentenced to 5 years probation for his conviction to Driving While Intoxicated, a class E felony.  The incident occurred on November 9, 2015, in the Town of Persia, when the defendant operated a motor vehicle in an intoxicated condition and at a time he had a child 15 years old or less as a passenger. 

BRANDON D. ROOT, 29, of Delevan, New York, was sentenced to two terms of 6 years with the New York State Department of Corrections, to run concurrently and 5 years of post release supervision, for each of his convictions to Rape in the First Degree, class B felony and Criminal Sexual Act in the First Degree, class B felony. The incidents occurred on April 9, 2016, in the Town of Yorkshire, when the defendant knowingly entered or remained unlawfully in a dwelling with intent to commit a crime therein, engaged in sexual intercourse with another person (s) by forcible compulsion, engaged in oral or anal sexual conduct with another person by forcible compulsion and during the commission of a felony, caused physical injury to another person.
